Privacy Policy

This policy explains how PHNTM AI LLC (“PHNTM,” “we,” “us,” or “our”) handles personal information when you use PHNTM Exec, our websites, emails, voice sessions, and related services (the “Service”).

PHNTM is a voice and AI service. Voice sessions are recorded, transcribed, analyzed, and stored with your account. Please do not start a session unless you consent to that processing and have obtained any consent required from other people who may be heard.

1. Scope and role

This policy applies to information PHNTM controls. Our vendors also process information under their own contracts and privacy terms. If you use the Service for a company, both your personal information and information about that company may be covered.

2. Information we collect

  • Account and identity data: name, email address, account identifiers, authentication status, and age/consent confirmations.
  • Business profile data: business name and type, revenue or financial context you choose to provide, goals, challenges, preferences, plans, and project information.
  • Voice and session data: audio, transcripts, call identifiers and timing, summaries, extracted commitments, tasks, notes, scores, and other AI-generated session content.
  • Feedback and support data: messages, ratings, feedback text, optional feedback audio and transcripts, and correspondence with us.
  • Billing data: selected plan, Stripe customer and subscription identifiers, subscription status, transaction and invoice metadata, and limited payment-method details Stripe makes available. PHNTM does not receive or store your full card number or card security code.
  • Communications data: email address, email content, delivery status, suppression or unsubscribe status, and operational email logs.
  • Technical and usage data: IP address, browser/device information, request and error logs, security events, feature usage, and session cost or usage metrics generated by the Service and its hosting providers.

3. Where information comes from

We receive information directly from you, automatically through your use of the Service, from your browser or device, and from providers such as Clerk, Retell, Stripe, and our hosting and email providers. We also create inferences, summaries, plans, and other output from the information you provide.

4. How we use information

  • Provide, personalize, maintain, and improve the Service and its memory across sessions.
  • Record, transcribe, summarize, and analyze voice sessions and generate tasks, plans, coaching, and other requested output.
  • Authenticate users, administer accounts and projects, process subscriptions, and provide customer support.
  • Send transactional messages and, where permitted, product or marketing communications.
  • Monitor reliability, enforce usage limits and agreements, prevent fraud or abuse, and protect PHNTM, users, and others.
  • Comply with law, respond to lawful requests, resolve disputes, and establish or defend legal claims.
  • Create aggregated or de-identified insights that cannot reasonably identify you.

5. Voice recordings and AI processing

Audio and transcripts are essential to PHNTM’s voice features. Retell provides voice and call infrastructure. Anthropic processes conversation text and relevant profile, project, and session context to generate live responses and post-session analysis. OpenAI is used to transcribe optional feedback audio. These systems can produce inaccurate or unexpected output. PHNTM does not use session output to make legally significant decisions about you.

Do not provide passwords, Social Security numbers, complete payment-card details, protected health information, or other specially regulated data. The Service is not designed for HIPAA, GLBA, education-record, or similar regulated-data compliance, and PHNTM does not agree to act as a regulated custodian unless we sign a separate written agreement.

6. How we disclose information

We disclose information only as described here, including to the following service providers:

  • Clerk: authentication, identity, and session management.
  • Supabase: application database and file storage.
  • Retell: voice infrastructure, call audio, transcripts, call records, and project knowledge context.
  • Anthropic: AI conversation, generation, and analysis using transcripts and relevant account or project context.
  • OpenAI: transcription of optional feedback audio.
  • Stripe: hosted Checkout, payment processing, subscription administration, invoices, and the hosted Customer Portal.
  • SendGrid: transactional and permitted marketing email delivery and suppression management.
  • Railway and Vercel: application hosting, delivery, networking, operational logs, and related infrastructure.

We may also disclose information to professional advisers, authorities when legally required, parties involved in protecting rights or safety, and a buyer or successor in a financing, merger, reorganization, or sale, subject to appropriate safeguards.

7. No sale or behavioral advertising

We do not sell personal information. We do not share personal information for cross-context behavioral advertising, and we do not use voice-session content to target third-party ads.

8. Retention

PHNTM currently does not apply an automatic expiration period to all application records. We generally retain account, project, session, and generated content while your account is active and until deletion is requested, unless a longer period is reasonably needed for the purposes described in this policy.

Deletion is not instantaneous or absolute. Call audio, transcripts, and call records held by Retell are subject to provider configuration and deletion processes. Email delivery records, consent evidence, security logs, billing and transaction records, dispute records, and legally required accounting records may remain after account deletion. Residual copies may also remain temporarily in backups or provider systems until their normal deletion cycles complete. We retain only what is reasonably necessary for operations, security, fraud prevention, legal compliance, or legal claims.

9. Security

We use administrative, technical, and organizational safeguards designed for the nature of the information we process, including access controls, authentication, encrypted network connections, provider security controls, and restricted production credentials. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

10. Your choices and privacy rights

Subject to verification, applicable law, and permitted exceptions, you may ask us to provide access to, correct, export, or delete personal information associated with you. You may also ask about our processing or appeal a denied privacy request. Email contact@phntm.app. We will not discriminate against you for exercising a privacy right.

You can unsubscribe from marketing emails through the link in the message. Transactional or security messages may continue while you maintain an account. Manage subscription billing and cancellation through Settings and Stripe’s hosted Customer Portal.

11. Children

The Service is only for people age 18 or older. We do not knowingly collect personal information from children. Contact us if you believe a person under 18 has provided data so we can investigate and take appropriate action.

12. United States processing

PHNTM is operated from the United States. Information may be processed in the United States and other locations where our providers operate, which may have different data-protection laws.

13. Changes and contact

We may update this policy as the Service or law changes. We will post the revised policy and, when changes are material, provide additional notice or request renewed acceptance where appropriate. Questions and privacy requests may be sent to PHNTM AI LLC at contact@phntm.app.
