Beta, AI & Recording Addendum

The Terms of Service and Privacy Policy are incorporated into this Addendum. Capitalized terms not defined here have the meaning in the Terms. If this Addendum conflicts with the Terms on a beta, recording, transcription, or AI-processing issue, this Addendum controls for that issue.

The Service is evolving and may contain defects, lose information, produce incorrect output, or experience interruption. Features, session limits, providers, models, and workflows may change. You should maintain independent records of information that is important to you and should not rely on PHNTM as your only system of record.

You knowingly consent to PHNTM and its providers capturing and recording your voice and any other audio transmitted during a session; generating and storing transcripts; analyzing the audio, transcript, and relevant account or project context; and generating live responses, summaries, notes, tasks, plans, scores, reminders, and other output.

This consent applies each time you start or continue a voice session while the current version of this Addendum is in effect. Recording and transcription are required for voice sessions. If you withdraw consent, do not start another session and contact us to request deletion. Withdrawal does not make prior processing unlawful and does not require deletion of records we may lawfully retain.

You may not allow another person’s communication to be captured unless you first clearly tell that person the session will be recorded, transcribed, stored, and processed by AI providers and obtain all consent required by every applicable law. You are responsible for people you invite, speakerphone use, forwarded audio, and intelligible background conversations. If consent is uncertain, stop the session or move to a private location.

Voice and AI functionality currently involves the following processing:

• Retell carries the live voice session and processes audio, transcripts, call records, and project knowledge context.
• Anthropic receives conversation text and relevant business, project, prior-session, task, and plan context to generate responses and analysis.
• Supabase stores application records and feedback files, while Railway and Vercel host and deliver Service components.
• OpenAI transcribes feedback audio only when you choose to submit audio feedback.

Business conversations may be confidential, but the Service is not a privileged adviser or a specially regulated record system. Do not disclose passwords, Social Security numbers, complete payment-card details, health records, another person’s secrets, or information whose disclosure to the providers listed in the Privacy Policy would violate a duty or law.

AI output can be wrong, incomplete, inconsistent, or unsuitable. PHNTM cannot make decisions, contact third parties, complete commitments, or verify real-world facts unless a feature expressly says it does so. You are responsible for verifying output and for all decisions, communications, filings, purchases, commitments, and actions taken in response to it. PHNTM makes no earnings, performance, or outcome guarantee.

PHNTM records your user identifier, document version, consent type, and acceptance time as evidence of agreement. We may require you to accept a new version before using the Service or starting another session. Questions, withdrawal notices, and privacy requests may be sent to contact@phntm.app.
