Beta Participation Agreement

1. The Closed Beta

Phantom Exec ("Phantom," "we," "us") is an early-stage product offered as a closed, invitation-only beta. Access is currently limited to participants located in the United States. The service is provided strictly "as is" and "as available," without warranties of any kind. Features may change, break, or be removed without notice, and the beta may end at any time.

We make no guarantee of availability, accuracy, or fitness for any particular purpose during the beta period.

2. Recording & Transcription Consent

Phantom is a voice assistant. Your sessions are voice-recorded, transcribed, and processed by automated AI systems in order to provide the service. This recording and processing is essential to how the product works — you cannot use Phantom without it.

By starting a session, you consent to the recording, transcription, and AI processing of your voice and the contents of your conversation. You agree not to share information about other people during sessions without their permission.

3. Privacy & Your Data

To deliver the service, we collect and process the following categories of information:

• Your email address and name
• Voice audio from your sessions
• Transcripts of your sessions
• Business and financial profile information you share (e.g. revenue, goals, challenges)
• Tasks, plans, and notes generated from your sessions

Sub-processors

We share data with the following third-party sub-processors solely to operate the service. Each receives only the data it needs for its function:

• RetellVoice infrastructure — receives voice audio and transcripts.
• AnthropicAI conversation and analysis — receives transcripts and profile context.
• OpenAIUsed only to transcribe feedback audio you choose to submit.
• SendGridEmail delivery — receives your email address and message content.
• SupabaseDatabase, storage, and authentication — stores your account and application data.

Data retention

We want to be candid: during the beta there is no automated data retention or expiry policy. Your data is kept until you request deletion. Deletion is handled manually in response to an email request (see Section 6).

4. Not Professional Advice

Phantom provides general business coaching, not professional financial, legal, or tax advice. Its responses are generated by AI and can be wrong, incomplete, or misleading. Always verify before acting, and consult a qualified professional for decisions that matter. Nothing Phantom says creates a professional or fiduciary relationship.

5. Age Requirement

You must be at least 18 years old to participate in the beta. By creating an account, you represent that you meet this requirement.

6. Data Deletion & Your Rights

To delete your account and data, email a request to TODO(legal): support email. On receipt, we will delete your account and associated data (transcripts, profile, tasks, plans) on a cascading basis, and we will ask our sub-processors to delete data they hold in accordance with their respective terms.

7. Limitation of Liability

To the maximum extent permitted by law, Phantom and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the beta. TODO(legal): liability cap.

8. Governing Law & Dispute Resolution

This agreement is governed by the laws of TODO(legal): governing-law state. Any dispute will be resolved by TODO(legal): binding arbitration terms, venue, and class-action waiver.
